The New Jersey Department of Environmental Protection (NJDEP) recently announced that significant changes will be coming to the Flood Hazard Area Control Act. It is expected the notice will be published on July 3rd or 17th of 2023, and the amended rules will be effective immediately. Some of the changes going into effect include:
- Stormwater facilities must manage runoff for present day storms and future storms based on the year 2100 rainfall projections (Notably higher than current rainfall data).
- The Rational and Modified Rational methods for stormwater calculations will no longer be acceptable.
- Flood Hazard Area (FHA) flood elevations will be raised by two feet.
- Possible grandfathering/legacy provisions.
