Engineering ABCs: What is an L.O.I.?

Many projects in New Jersey are impacted by Freshwater Wetlands. When this occurs, an LOI (Letter of Interpretation) can be applied for from NJDEP (New Jersey Department of Environmental Protection). This document formalizes and approves a survey of the property which graphically depicts the extents of the wetlands on the property in question. Additionally, a buffer will be assigned which designates a distance from the wetland that are also regulated. The distance of the buffer has several contributing factors, including the potential for habitat of threatened and endangered species and range from none (0’) to 150’. The LOI can be relied upon for 5 years.

It is critical to obtain this information at the beginning of the project, preferably during Due Diligence. The difference in impact between no wetlands or buffers to 150’ bisecting a property can be fatal to a project.
